If you have a hearing about a proposed planning instrument, it must be cancelled if the hearing is set to start more than 5 working days after the rules started, unless you have an exemption under section 80U. You can also avoid cancelling the hearing if the local authority asks the Minister for an exemption under section 80V and the Minister says yes. The Minister can also stop the hearing from being cancelled if they direct against a withdrawal under section 80T.

80SWhen hearing must be cancelled

  1. If a date later than 5 working days after the commencement of this subpart has been set to begin hearing a proposed planning instrument, the hearing must be cancelled unless—

  2. an exemption applies under section 80U; or
    1. the local authority has applied for, and the Minister has granted, an exemption under section 80V; or
      1. the Minister directs against a withdrawal under section 80T.
