95G: Meaning of affected customary marine title group

A customary marine title group is considered an affected customary marine title group when an activity might happen in their customary marine title area. This applies to accommodated activities. For a group to be considered affected, two things need to be true:

First, the activity might make it harder for the group to use their rights. These rights are described in subpart 3 of Part 3 of the Marine and Coastal Area (Takutai Moana) Act 2011.

Second, the group hasn’t said it’s okay for the activity to happen. They need to tell the consent authority in writing that they approve before the authority makes a decision about this.

95GMeaning of affected customary marine title group

  1. A customary marine title group is an affected customary marine title group, in relation to an accommodated activity in the customary marine title area relevant to that group, if—

  2. the activity may have adverse effects on the exercise of the rights applying to a customary marine title group under subpart 3 of Part 3 of the Marine and Coastal Area (Takutai Moana) Act 2011; and
    1. the customary marine title group has not given written approval for the activity in a written notice received by the consent authority before the authority has made a decision under this section.
