Illustration for Resource Management Act 1991

The Minister can extend the expiry date of a wastewater consent that already exists. You need to know that this can happen if the Minister thinks there are exceptional circumstances. The expiry date can be extended for a maximum of 2 years. The Minister can extend the expiry date after you apply under section 139E. The Minister can also extend the expiry date without an application. This means the Minister can make the decision on their own. The Minister's decision to extend the expiry date can happen more than 3 years after the commencement date. The Minister has the power to make this decision in exceptional circumstances.
