If you live in a care home and the government is paying for some or all of your care, you can’t get a disability allowance for expenses related to your disability.

You also can’t get a disability allowance if you have a psychiatric, intellectual, physical, or sensory disability and the government is paying for your accommodation or care outside your own home under the Pae Ora (Healthy Futures) Act 2022.

Any rules made about using disability allowances for specific expenses must follow these guidelines.

86Disability allowance: excluded expenses

  1. A disability allowance is not payable in respect of—

  2. expenses arising from the disability of a person who is a resident assessed as requiring care in respect of whom a funder is paying some or all of the cost of contracted care services under section 54, 55, 56, 57, or 58 of the Residential Care and Disability Support Services Act 2018; or
    1. expenses arising from the disability of a person that are costs of residential care services provided to the person if—
      1. the person has a psychiatric, intellectual, physical, or sensory disability; and
        1. the person’s accommodation costs or care (other than care in the person’s own home) is wholly or partly funded under the Pae Ora (Healthy Futures) Act 2022.
        2. Regulations made under section 426 (use of disability allowance to fund specified expenses) must not be inconsistent with this section.
