410: Appeal, with Supreme Court’s leave, against High Court’s or Court of Appeal’s determination

You can ask the Supreme Court for permission to appeal against a decision made by the High Court or Court of Appeal. This applies to two types of decisions:

  1. When the High Court has made a decision on an appeal under section 405.
  2. When the Court of Appeal has made a decision on an appeal under section 409.

If you were part of the case in either of these situations, you can apply to the Supreme Court for permission to appeal. You need to follow the rules set out in the Senior Courts Act 2016 when you apply.

410Appeal, with Supreme Court’s leave, against High Court’s or Court of Appeal’s determination

  1. This section applies to a determination that is—

  2. a determination of the High Court made in a proceeding that is an appeal under section 405; or
    1. a determination of the Court of Appeal made in a proceeding that is an appeal under section 409.
      1. Any party to the proceeding specified in subsection (1)(a) or (b) may apply, in accordance with the Senior Courts Act 2016, to the Supreme Court for leave to appeal against the determination.
