208Beneficiary resident in institution for treatment of alcoholism or drug addiction

  1. This section applies if a person (P) is—

  2. a beneficiary; and
    1. a resident of an institution for the treatment of alcoholism or drug addiction.
      1. The rate of any benefit payable to P while a resident of the institution is determined by MSD after taking into account P’s personal financial circumstances.

      2. In subsection (1), institution for the treatment of alcoholism or drug addiction means a treatment centre under the Substance Addiction (Compulsory Assessment and Treatment) Act 2017 (the 2017 Act) (not being a psychiatric security institution within the meaning of the Mental Health (Compulsory Assessment and Treatment) Act 1992) or any institution that fulfils a similar purpose to a treatment centre under the 2017 Act.
