When you don’t follow these rules, it’s called a ‘failure’. There are three types of failures:

  1. A ‘first failure’ is when you don’t follow a rule for the first time.
  2. A ‘second failure’ happens if you don’t follow a rule again after you’ve fixed your first failure.
  3. A ‘third failure’ occurs if you don’t follow a rule once more after fixing your second failure.

The law also explains what it means by ‘young parent obligations’ and ‘young person obligations’. These are different sets of rules that young parents and young people need to follow when they receive certain types of payments from the government.

A ‘young parent payment’ is money given to young parents who meet certain conditions. If you’re young and have a partner who gets benefits, it can also include part of your partner’s benefit that you receive.

A ‘youth payment’ is similar, but it’s for young people without children. If you’re young and have a partner who gets benefits, it can also include part of your partner’s benefit that you receive.

268Failure, and first, second, and third failure, defined for young person or young parent obligations

  1. In this subpart,—

    failure means a failure to comply with a young person obligation or a young parent obligation

      first failure means the first failure of a young person or young parent obligation

        second failure means a failure that occurs after the young person concerned has satisfied the obligation to which a first failure related

          third failure means a failure that occurs after the young person concerned has satisfied the obligation to which a second failure related

            young parent obligation means—

            1. an obligation, under Part 3, of a young person who is receiving a young parent payment; or
              1. an obligation under section 167 (young person aged 16 to 19 years with dependent child and who is spouse or partner of specified beneficiary)

                young parent payment, in relation to a young person who is the spouse or partner of a specified beneficiary and is subject to obligations under section 167, means—

                1. a young parent payment payable under subpart 8 of Part 2; and
                  1. the portion of the specified beneficiary’s main benefit the young person receives

                    young person obligation means—

                    1. an obligation, under Part 3, of a young person receiving a youth payment; or
                      1. an obligation under section 166 (young person aged 16 or 17 years with no dependent child who is spouse or partner of specified beneficiary); or
                        1. for the purposes only of sections 275 and 276, an obligation, under Part 3, of a young person on whom section 165(7)(a) or 168(6)(a) imposes that obligation as if the young person’s jobseeker support, or the portion of the jobseeker support or the specified beneficiary’s benefit payable to the young person under section 337, were a youth payment

                          youth payment, in relation to a young person who is a spouse or partner of a specified beneficiary and is subject to obligations under section 166, means—

                          1. a youth payment payable under subpart 7 of Part 2; and
                            1. the portion of the specified beneficiary’s main benefit the young person receives.
