If you can’t earn enough money for yourself or the people who depend on you, you might be able to get some help. This help is called an emergency benefit. You can ask for this if you’re not getting any other main benefits or New Zealand superannuation or a veteran’s pension. The people who decide about benefits (called MSD) will look at your situation to see if you can get this emergency help.

Sometimes, MSD might give you an emergency benefit instead of other types of help like supported living payment, sole parent support, or jobseeker support. They get to choose how much money to give you for the emergency benefit. But they can’t give you more than you would get if you were getting a regular benefit in a situation like yours.

MSD can also add special rules just for you when they give you an emergency benefit. They look at each person’s situation separately to decide what’s best.

Emergency benefit

63Emergency benefit: discretionary grant on ground of hardship

  1. MSD may grant an emergency benefit on the ground of hardship to a person (P)—

  2. who is unable to earn enough income for P or P’s dependants (if any); and
    1. who is not entitled to a main benefit under this Act (other than an emergency benefit) or to New Zealand superannuation or a veteran’s pension; and
      1. to whom MSD has determined not to grant 1 of the following benefits on ground of hardship: jobseeker support, youth payment, or young parent payment.
        1. Despite subsection (1)(b), MSD may grant an emergency benefit to a person (P) instead of or in substitution for a supported living payment, sole parent support, or jobseeker support.

        2. The rate of an emergency benefit is at the discretion of MSD.

        3. However, the rate of an emergency benefit must not exceed the rate of the equivalent benefit, that is, the main benefit under this Act (other than an emergency benefit) that MSD would grant to a person entitled to the benefit in circumstances similar to P’s.

        4. MSD may, on a case-by-case basis, make the grant of an emergency benefit subject to any conditions imposed by MSD.
