7: Minister may give MSD binding directions

You could also call this:

"The Minister can give the Ministry of Social Development instructions they must follow."

Illustration for Social Security Act 2018

The Minister can give the Ministry of Social Development (MSD) written directions about their duties and powers under certain laws, including the Social Security Act 2018 and the New Zealand Superannuation and Retirement Income Act 2001. You need to know that these directions can be general or special, and they are binding on MSD. The Minister's directions cannot override certain other kinds of directions, such as those about preferred suppliers given under section 372 or debt recovery directions given under regulations made under section 444.

MSD must follow all current directions given by the Minister when performing their duties. A direction given by the Minister under this section is considered secondary legislation, which means it has to be published in a certain way, as explained in Part 3 of the Legislation Act 2019. This helps you understand how the Minister's directions are made and what they mean for MSD.
