52: When person has parental support gap

You are considered to have a parental support gap if any of these things are true:

Your parents or guardians can’t give you financial support. This might be because they don’t have enough money to help you.

Your relationship with your parents or guardians has broken down, and they won’t give you financial support anymore.

You used to be under a CYPFA order or agreement, but you’re not anymore.

MSD (which stands for Ministry of Social Development) thinks that you can’t reasonably be expected to depend on your parents or anyone else for money.

However, you don’t have a parental support gap if you could live with a parent or guardian but choose not to, and MSD doesn’t think you have good enough reasons for that choice.

52When person has parental support gap

  1. In this subpart, a person (P) has a parental support gap if—

  2. none of P’s parents (and guardians (if any)) is able to support P financially; or
    1. P’s relationship with P’s parents (and guardians (if any)) has broken down, and none of them is prepared to support P financially; or
      1. P was, but is no longer, subject to a CYPFA order or agreement; or
        1. MSD is otherwise satisfied that P cannot reasonably be expected to be financially dependent on P’s parents or any other person.
          1. However, P does not have a parental support gap if—

          2. P has the option of living with a parent or guardian but chooses not to; and
            1. MSD is not satisfied that there are good and sufficient reasons for P’s choice.
