439: Regulations: certain benefits granted, or granted at rate, not taking into account certain insurance payments

The Governor-General can make rules about certain benefits and insurance payments. These rules are for section 310 of the Social Security Act 2018.

439Regulations: certain benefits granted, or granted at rate, not taking into account certain insurance payments

  1. The Governor-General may, by Order in Council, make regulations for the purposes of section 310.

  2. Regulations made under subsection (1) may (without limitation) do all or any of the following:

  3. specify the insurance payments and benefits or kinds of benefits to which the regulations apply:
    1. authorise MSD to suspend, cancel, or vary the rate of, the benefit, from a date MSD determines.
      1. Regulations under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
