390: What this Part does

This part of the law tells you about different ways you can ask for a review or appeal if you don’t agree with a decision about your social security benefits.

You can ask a group called a benefits review committee to look at a decision made by the Ministry of Social Development (MSD) if you’re not happy with it.

If you’re still not satisfied after the review, you can appeal to an appeal authority. You can do this if the benefits review committee has confirmed or changed the decision, or if the head of MSD made the decision themselves.

If you think the appeal authority made a mistake about the law, you can ask the High Court to look at it. This is called appealing on a question of law.

If you’re not happy with what the High Court decides, you can ask the Court of Appeal for permission to appeal to them.

In some cases, you might even be able to ask the Supreme Court for permission to appeal to them. This is the highest court in New Zealand.

There’s also a special group called the medical board. You can appeal to them if MSD made a decision about your health or ability to work that you don’t agree with.
