When there’s a disease outbreak in another country, the Minister can create special help programmes for visitors who can’t go back home quickly because of the outbreak. This happens when there’s an overseas epidemic management notice in effect. The Minister will write down the details of the programme, including who can get help, how much help they can get, and for how long. The Minister will also say if there are any rules people need to follow to get the help. This special programme is more important than other parts of this law. The government can spend money on this programme without needing extra permission. If the Minister makes a notice about this programme, it becomes a type of law called secondary legislation.

100Special assistance for visitors affected by overseas epidemics

  1. The Minister may, in respect of any period for which an overseas epidemic management notice is in force, by written notice establish programmes of special assistance for visitors to New Zealand who are prevented or hindered from returning promptly to places stated in the notice by the outbreak outside New Zealand of the disease stated in the notice.

  2. The notice must state—

  3. the criteria for determining which people are given assistance; and
    1. any maximum amounts of assistance to be given; and
      1. if different amounts of assistance may be given to different people, the criteria for determining how much assistance people are given; and
        1. for how long assistance may be given; and
          1. any conditions subject to which assistance is to be given.
            1. The programme, and the matters stated in the notice establishing it, override every other provision of this Act.

            2. The Crown may incur, without further appropriation than this subsection, expenses or capital expenditure for the purpose of providing special assistance under this section.

            3. A notice under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
