Land Transport Act 1998

Land transport secondary legislation

159: Rules concerning land transport documents

You could also call this:

“Rules about getting special papers for transport jobs and activities”

The rules can say that you need a land transport document for things like vehicles, people who use roads, and companies that provide transport services. This document might also be needed for places that teach about transport, people who check vehicles, and those who design and build them. Even the people in charge of roads might need one.

These rules can explain what you need to do to get one of these documents, what standards you have to meet, and how long the document lasts before you need a new one.

If you want a document for a job where you work with the public, like teaching people to drive, you might need to show that you’re a good person to do that job. The rules can say what makes someone right for the job.

The rules can also say how to get, change, replace, or give up these documents. They can also say when the documents run out, or when they can be taken away.

The person in charge, called the Director, can give out these documents. They decide how long the document lasts and what rules you need to follow when you have it.

These rules are part of the law, which means they’re official and everyone needs to follow them.

                      2. The rules may require a person who applies for or holds a land transport document that is required for the provision of a service that involves contact with the public (such as driving instruction or driver testing) to satisfy the Director that the person is a fit and proper person to hold that document, and—

                          1. The rules may provide for the issue, endorsement, alteration, replacement, renewal, surrender, expiry, suspension, and revocation of land transport documents.

                          2. Subject to the rules, a land transport document may be issued or a document may be recognised as a land transport document, as the case may be, by the Director for such period and subject to such conditions as the Director considers appropriate in each particular case.

                          3. Ordinary rules under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
