197: Inspection of records or other information

If you import vehicles, the Director can ask you to show them any records or information you have that they think they need to check if you’re following the clean vehicle standard rules.

The Director can look at these records or information and make copies. If you choose to show the records at your place or somewhere else, the Director can make copies there. If it’s too hard to copy them there, the Director can take the records away.

If the Director takes your records, they must give you a receipt. They have to return your records as soon as they can. While they have your records, you can look at them and make copies at any time that makes sense, at the place where the Director is keeping them.

197Inspection of records or other information

  1. The Director may require a vehicle importer to produce for inspection any records or other information in the vehicle importer’s possession or control that the Director reasonably considers necessary to establish compliance with the requirements and obligations of the clean vehicle standard.

  2. The Director may, in relation to any records or other information produced under subsection (1),—

  3. inspect and make copies of, or take extracts from, the records or other information:
    1. where the vehicle importer chooses to produce the records or other information at their premises or any other place of inspection,—
      1. make copies of the records or other information at the place of inspection:
        1. remove the records or other information if the Director is satisfied that it is impracticable to copy the records or other information at the place of inspection.
        2. If the Director removes any records or other information under subsection (2)(b)(ii), the Director must—

        3. issue a receipt for the records or other information to the person from whom the records or other information was taken; and
          1. return the records or other information as soon as practicable; and
            1. for as long as the Director holds the records or other information, allow the person from whom the records or other information was taken to inspect, and obtain copies of, the records or other information at any reasonable time at the premises where the records or other information is held.
