Land Transport Act 1998

Transport services licensing - Fit and proper person test - Assessment criteria

30D: Additional criteria for small passenger service and vehicle recovery service

You could also call this:

“Extra things to check when deciding if someone can run a taxi or tow truck service”

When the Director is deciding if someone is fit and proper to run a small passenger service or a vehicle recovery service, they need to look at some specific things. These are in addition to other things they might consider.

The Director will look at whether you have had any serious behaviour problems in the past. They will also check if you have committed any violent crimes, sexual crimes, drug crimes, weapon crimes, or been involved in organised crime.

The Director will see if you have committed any major transport-related crimes, especially ones about safety or road user charges. They will also look at whether you keep committing crimes of any kind.

Lastly, the Director will consider any complaints made about you or any transport service you run. They will pay attention to complaints that happen a lot or are very serious.
