This part of the law applies to you when you’re driving certain types of vehicles during your work time. It applies if you’re driving a vehicle that needs a class 2, 3, 4, or 5 licence. It also applies if you’re driving a vehicle for a transport service (but not a rental service), or if you should be operating under a transport service licence. If you’re driving a heavy vehicle to carry goods for money, this law applies to you too.

The law applies whether your vehicle is being used for a transport service or not, and whether you’re carrying anything or anyone. However, it doesn’t apply if you’re driving a goods service vehicle that only needs a class 1 or 2 licence, is used within 50 km of where it’s usually based, and isn’t being used to make money.

Remember, these rules are subject to section 30Z of the Land Transport Act 1998.

30ZEApplication of subpart

  1. This subpart applies if, in a cumulative work period,—

  2. a driver drives a vehicle that requires a class 2, 3, 4, or 5 licence (as specified in the rules); or
    1. a driver drives a vehicle that is used in—
      1. a transport service (other than a rental service); or
        1. circumstances in which the vehicle must, or ought to, be operated under a transport service licence; or
        2. a driver drives a vehicle that is used to carry goods for hire or reward if that vehicle is a heavy motor vehicle.
          1. Despite subsection (1), this subpart—

          2. applies whether or not the vehicle is—
            1. engaged in any transport service; or
              1. carrying any load or passengers; but
              2. does not apply to a driver of a goods service vehicle that—
                1. requires a class 1 or class 2 licence (as specified in the rules); and
                  1. is used within a 50 km radius of the vehicle's normal base of operation; and
                    1. is not used for hire or reward.
                    2. This section is subject to section 30Z.
