65BMandatory zero alcohol requirements for repeat offences and certain first offences

  1. This section applies if a court has authorised a person to apply for a zero alcohol licence under any of the following sections:

  2. section 65AC(2)(d):
    1. section 65AI(c):
      1. section 100B(2)(b).
        1. A zero alcohol licence has effect for a period of 3 years from the date the licence is issued.

        2. A person authorised under a section referred to in subsection (1) may apply for a zero alcohol licence,—

        3. in the case of a person who is subject to 1 or more orders of disqualification, no earlier than the day after the end of the last period of disqualification to which the person is subject; or
          1. in the case of a person who is subject to an alcohol interlock sentence, when the Director makes an order under section 100A(1).
            1. A person who has been authorised to apply for a zero alcohol licence and who does not apply for a zero alcohol licence is disqualified from holding or obtaining a driver licence.
