43ACourts may impose appropriate fines for infringement offences that are not overloading offences

  1. A court may impose a fine for an infringement offence, other than an overloading offence, that is not more than the maximum fine prescribed for that offence, whether the fine imposed is more than, the same as, or less than the prescribed infringement fee for that offence.
