159A: Ordinary rule may require committee to be established

An ordinary rule can tell the Agency to set up a committee for speed management. This committee might review plans for state highway speeds or look at information about managing speed.

The rule must explain why the committee is being created, what it can do, and who can choose its members. The people who might pick committee members are the Minister, the Agency, the Director, the Secretary, or a mix of these people.

The rule can also say when the committee will end and how it will work. When choosing committee members, the person in charge must follow the rules in Section 96B of the Land Transport Management Act 2003. The committee must also follow the rules in Section 96C of that Act.

Part 11 Land transport secondary legislation

159AOrdinary rule may require committee to be established

  1. An ordinary rule may require the Agency to establish a committee that has 1 or more purposes associated with speed management, including—

  2. reviewing a state highway speed management plan provided for in a rule:
    1. reviewing guidance or information on speed management prepared by the Agency.
      1. The rule must set out—

      2. the purpose for which the committee is to be established; and
        1. the committee’s functions, powers, and duties; and
          1. which of the following persons is authorised to appoint members of the committee (and the term for which they are appointed):
            1. the Minister:
              1. the Agency:
                1. the Director:
                  1. the Secretary:
                    1. any combination of the persons listed in subparagraphs (i) to (iii).
                    2. The rule may set out—

                    3. the date on which the committee is to be dissolved or a process by which that date is determined:
                      1. any other matter relating to establishing and operating the committee.
                        1. Section 96B of the Land Transport Management Act 2003 applies when the relevant person referred to in subsection (2)(c) of this section is considering appointing a member of a committee established by a rule under this section.

                        2. Section 96C of the Land Transport Management Act 2003 applies to any committee established by a rule under this section.

                        3. Ordinary rules under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
