30ZB: Application of subpart

This part of the law applies to you when you drive certain types of vehicles during your work time. It covers you if you drive a vehicle that needs a class 2, 3, 4, or 5 licence. It also applies if you use a vehicle for a transport service (except rental services), or if you should be operating under a transport service licence. The law also covers you if you use a vehicle to carry goods for money.

These rules apply whether or not you’re actually working in a transport service at the time, and whether or not you’re carrying any load or passengers.

However, there’s an exception. The law doesn’t apply to you if you’re driving a goods service vehicle that needs a class 2 licence, is used within 50 km of where it’s normally based, and isn’t being used to make money.

Remember, these rules are subject to section 30Z of the Land Transport Act 1998.

Work time

30ZBApplication of subpart

  1. This subpart applies if, in a cumulative work period, a driver drives a vehicle that—

  2. requires a class 2, 3, 4, or 5 licence (as specified in the rules); or
    1. is used in—
      1. a transport service (other than a rental service); or
        1. circumstances in which that vehicle must, or ought to, be operated under a transport service licence; or
        2. is used to carry goods for hire or reward.
          1. Subsection (1) applies whether or not the vehicle is—

          2. engaged in any transport service; or
            1. carrying any load or passengers.
              1. Subsection (1) does not apply to the driver of a goods service vehicle that—

              2. requires a class 2 licence (as specified in the rules); and
                1. is used within a 50 km radius of the vehicle's normal base of operation; and
                  1. is not used for hire or reward.
