30ZADirector may grant exemptions or approve alternative fatigue management schemes

  1. If the Director takes into account the criteria specified in section 168D(3), the Director may, upon any conditions that the Director considers appropriate,—

  2. with respect to subpart 1, grant written variations to work time requirements specified in subpart 1 or the rules:
    1. with respect to subpart 2, grant partial or total written exemptions from some or all of the requirements to maintain logbooks:
      1. approve, in accordance with the rules, an alternative fatigue management scheme that varies the work time restrictions or rest time requirements of any rule for specified drivers covered by the relevant transport service licence.
        1. A variation or exemption granted, or an approval given under subsection (1), in relation to work time or logbooks may be amended or revoked at any time by the Director in writing.

        2. The Director may revoke, by notice in writing, any exemption from logbook use granted under the rules if the Director has reason to believe that the person has breached the rules or any conditions imposed under subsection (1).

        3. Before approving an alternative fatigue management scheme under subsection (1)(c), the Director must be satisfied that the applicant has consulted any representatives of the drivers covered by the relevant transport licence (including, but not limited to, unions).
