216: Transitional regulations

  3. For a set time, these regulations can:
    • Say that some parts of the Act don’t apply yet
    • Give special meanings to certain words
    • Keep some old rules working even though the Act has changed them
  4. They can make rules about things that would usually be covered by rules made under section 158 of this Act.

216Transitional regulations

  1. Without limiting the powers conferred by section 167, the Governor-General may from time to time, by Order in Council, make regulations—

  2. prescribing transitional and savings provisions concerning the coming into force of this Act, which may be in addition to or in place of the transitional and savings provisions of this Part:
    1. to facilitate the bringing into force of any rules under this Act; and to remove any inconsistency between regulations or orders made under the Transport Act 1962:
      1. providing that subject to such conditions as may be specified in the regulations, during a specified transitional period,—
        1. specified provisions of this Act (including definitions) do not apply:
          1. specified terms have the meanings given to them by the regulations:
            1. specified provisions repealed or amended or revoked by this Act are to continue to apply:
            2. prescribing matters that would otherwise be covered by rules made under section 158.
              1. Regulations under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
