The Registrar can give some of their jobs or powers to other people. This is called delegation. The Registrar can choose who to delegate to and what tasks they can do.

If the Registrar wants to delegate to someone who doesn’t work for the government, they need to get permission from the Minister first.

The person who gets delegated tasks can do those jobs just like the Registrar would. They might even be allowed to pass on some of those tasks to other people, but they need to ask the Minister first.

When someone is doing a job for the Registrar, they have to follow some rules. They need to share information if people ask for it, and they can be checked by special officials called Ombudsmen.

The Registrar can set rules about how the delegated tasks should be done. They can also take back the delegation whenever they want.

Even if the Registrar gives a job to someone else, they can still do that job themselves if they want to.

If someone is doing a job for the Registrar and you ask them to prove it, they should be able to show you that they’re allowed to do that job.

When this law talks about a ‘person’, it means a company too, but not a group of people that isn’t officially organised as a company.

272Delegations

  1. The Registrar may, either generally or particularly, delegate to specified persons any of the Registrar's functions or powers under this Part.

  2. However, subsection (1) does not permit the Registrar to delegate a function or power to a person or a class of persons not employed in the State services (within the meaning of the Public Service Act 2020), except with the written consent of the Minister.

  3. If the Registrar delegates functions or powers to a person under this section, that person—

  4. may, with the prior approval of the Minister, delegate to another person approved functions or powers; and
    1. is, in the case of a person not employed in the State services, subject to—
      1. the Official Information Act 1982; and
        1. the Ombudsmen Act 1975.
        2. A person to whom functions or powers are delegated under this section may perform those functions and exercise those powers in the same manner and with the same effect as if they had been conferred or imposed upon the person directly and not by delegation.

        3. The Registrar may—

        4. delegate a function or power under this section to a specified person or class of persons or to the holder or holders of a specified office or class of office for the time being; and
          1. impose general or special directions or conditions.
            1. A delegation may be given for a specific or indefinite period, but in either case is revocable at will.

            2. A delegation of a function or power does not prevent the performance of that function or the exercise of that power by the Registrar.

            3. A delegation given under this section—

            4. continues in force according to its tenor until it is revoked, even if the Registrar who gave the delegation ceases to be Registrar; and
              1. continues to have effect as if it were made by the person appointed as Registrar.
                1. A person acting or purporting to act under a delegation under this section must, when reasonably requested, produce evidence of the person's authority to do so.

                2. In this section, person includes a body corporate, but does not include an unincorporated body of persons.
