The Director can revoke a transport service licence if they think the holder is not a fit and proper person. You are not a fit and proper person if you do something that shows you cannot be trusted to hold a transport service licence. The Director can also revoke a licence if someone in control of the transport service, a representative, or a driver is not a fit and proper person. The Director does not consider drivers who connect with passengers under a facilitated cost-sharing arrangement when deciding if a representative is fit and proper. If the Director decides to revoke a transport service licence, Subpart 5 applies to that decision. This means the Director must follow the rules in Subpart 5 when revoking a licence.

30SWhen Director may revoke transport service licence

  1. The Director may revoke a transport service licence if the Director is satisfied that—

  2. the holder of the transport service licence is not a fit and proper person to be the holder of a transport service licence; or
    1. any person who has control of the transport service is not a fit and proper person to have control of the service; or
      1. any representative who lives in New Zealand is not a fit and proper person to be a representative; or
        1. any driver is not a fit and proper person.
          1. Subsection (1)(c) does not apply in relation to drivers who are facilitated to connect with passengers under a facilitated cost-sharing arrangement.

          2. Subpart 5 applies to a decision to revoke a transport service licence.
