210A: Transfer of responsibilities between regional councils and territorial authorities

You should know that regional councils and territorial authorities can swap some of their jobs under the Land Transport Act. A regional council can give some of its tasks to a territorial authority. Similarly, a territorial authority can hand over some of its duties to a regional council. They do this using a rule called section 17 in the Local Government Act 2002.

When we talk about ‘responsibilities’ here, we mean any job, duty, or legal task that these authorities have under the Land Transport Act. This includes responsibilities that have been swapped before, and any powers that come with these jobs.

It’s important to understand that these authorities can transfer responsibilities back and forth. This means a job that was already transferred once can be transferred again.

210ATransfer of responsibilities between regional councils and territorial authorities

  1. A regional council may transfer 1 or more of its responsibilities under this Act to a territorial authority under section 17 of the Local Government Act 2002.

  2. A territorial authority may transfer 1 or more of its responsibilities under this Act to a regional council under section 17 of the Local Government Act 2002.

  3. In this section, responsibility means any responsibility, duty, or legal obligation under this Act and includes—

  4. a responsibility that has previously been transferred under section 17 of the Local Government Act 2002; and
    1. any powers associated with the responsibility, duty, or legal obligation.
