179: Category 1 light vehicle importer may defer obligation

If you bring in light vehicles to New Zealand, you might be called a ‘category 1 light vehicle importer’. This law applies to you in the years 2023, 2024, and 2025.

You have to meet certain targets for the vehicles you bring in each year. But if you need more time, you can ask to delay meeting your target. You can do this by applying to the Director.

If you delay your target from one year (let’s call it year 1) to the next year (year 2), you have to make sure you meet both years’ targets by the end of year 2. This means you’ll need to do better than just meeting one year’s target.

If you don’t meet both targets by the end of year 2, you might have to pay charges. These charges are explained in section 177 of the law.

179Category 1 light vehicle importer may defer obligation

  1. This section applies in relation to obligation years 2023, 2024, and 2025.

  2. A category 1 light vehicle importer may apply to the Director, in accordance with the regulations, to defer their obligation to meet the category 1 light vehicle importer fleet target for an applicable obligation year (year 1) until the following obligation year (year 2).

  3. If a category 1 light vehicle importer defers their year 1 obligation until year 2, the importer must, at the end of year 2, ensure that they have met or bettered both the year 1 and the year 2 fleet targets.

  4. If the vehicle importer does not meet the year 1 and year 2 fleet targets, the charges in section 177 apply.
