163: Procedure for making emergency rules

When the Agency wants to make an emergency rule, they need to talk to different people first. They will ask for opinions from groups that work with land transport, government departments, and other important organisations. The Agency decides who they need to talk to.

Emergency rules can only be in place for 90 days. If needed, they can be extended once for another 90 days. This means an emergency rule can last for a maximum of 180 days.

If an emergency rule says something different from a normal rule, the emergency rule is the one you should follow. The emergency rule is more important than the normal rule when they don’t agree with each other.

163Procedure for making emergency rules

  1. Before making an emergency rule, the Agency must consult with such persons, representative groups within the land transport system or elsewhere, government departments, and Crown entities as the Agency in each case considers appropriate.

  5. An emergency rule may be in force for a period not exceeding 90 days, and may be renewed once only for a further period not exceeding 90 days.

  6. So far as any emergency rule is inconsistent with or repugnant to any ordinary rule made under this Act, the emergency rule prevails.
