A water organisation can set and collect charges for services like water supply, stormwater, and wastewater. You might be charged for connecting to these services for the first time. The water organisation can also charge you for things like serviceability, which is explained in section 88, and for the costs of providing these services.

When setting a charge, the water organisation decides how you will be charged, when you need to pay, and how you can pay. They might charge you a fixed or variable amount, or charge you based on how much water you use. The water organisation can require you to pay a deposit, or pay the full amount at the start.

The water organisation must set charges in accordance with their water services strategy, which is explained in sections 230 and 231. However, they cannot base charges on a property's rateable value. Trade waste services are services provided to deal with waste from businesses, and you might be charged for these services.

Charges for water services

86Water organisation may set charges

  1. A water organisation may set and collect charges for 1 or more of the following:

  2. water supply services:
    1. stormwater services:
      1. wastewater services, including trade waste services.
        1. A charge set and collected under subsection (1) may include charges for 1 or more of the following:

        2. the initial connection to 1 or more of the services specified in subsection (1):
          1. serviceability (see section 88):
            1. meeting the costs that the water organisation incurs in performing and exercising its duties, functions, and powers in relation to providing water services.
              1. When setting a charge, the water organisation may determine—

              2. how the charge is assessed; and
                1. when the charge is due; and
                  1. how the charge is collected; and
                    1. how the charge may be paid.
                      1. When determining whether to set a charge, or how a charge is to be collected or may be paid, the water organisation may (by way of example) do 1 or more of the following:

                      2. charge a fixed or variable charge:
                        1. charge according to water usage or wastewater flow:
                          1. require a deposit and then further payment:
                            1. require full payment at the outset:
                              1. charge on the basis of an hourly rate or any other rate of service or by any other method of charging.
                                1. For the purposes of subsection (2)(b), a charge for serviceability is a charge in respect of a property to which section 88 applies.

                                2. A charge set under this section—

                                3. must be set in accordance with the water organisation’s water services strategy (see sections 230 and 231); but
                                  1. must not be based on, or take into consideration, a property’s rateable value.
                                    1. In this section, trade waste services means services provided in relation to trade waste.
