When you read this part of the law, you need to understand what some words mean. The word land refers to privately owned land, but it does not include roads and level crossings. You can find the meaning of level crossing in section 4(1) of the Railways Act 2005.

The word road includes streets, public footpaths, and State highways that people can access. It also includes bridges, culverts, ferries, and fords that are part of a road. However, road does not include motorways as defined in section 2(1) of the Government Roading Powers Act 1989, private roads as defined in section 315 of the Local Government Act 1974, or certain roadways laid out by the Māori Land Court under sections 315 to 326D of Te Ture Whenua Maori Act 1993.

The term State highway is defined in section 5(1) of the Land Transport Management Act 2003. You can look up these links to learn more about what these words mean. This will help you understand the law better.
