When you apply for an exemption under section 64, the Secretary gets your application and must talk to some other groups about it. The Secretary talks to the Water Services Authority, the Commerce Commission, and the Inland Revenue Department. Then the Secretary advises the Minister whether to grant the exemption.

The Minister looks at the Secretary's advice and decides what to do next. The Minister can recommend that the exemption be granted by order under section 66, or decline the application. The Minister can also recommend that the exemption be granted with some conditions or only partly.

Before the Minister recommends an exemption, they must be sure it will not stop the water organisation from following the law. The Minister must also be sure the exemption will not hurt the water organisation's ability to meet its goals or its financial stability. If the Minister declines the application, they tell the Secretary to notify the shareholders and the territorial authority that applied.

65Process for considering application for exemption

  1. On receipt of an application under section 64, the Secretary must—

  2. consult the Water Services Authority, the Commerce Commission, and the Inland Revenue Department in relation to the application; and
    1. advise the Minister whether to recommend granting an exemption, including—
      1. whether the exemption should be subject to any terms and conditions; and
        1. whether the exemption should be granted in full or in part.
        2. After receiving the Secretary’s advice, the Minister must—

        3. recommend that an exemption be granted by order under section 66; or
          1. decline the application.
            1. The Minister may recommend that the exemption be granted—

            2. subject to any terms or conditions; or
              1. in full or in part.
                1. The Minister must not recommend an exemption unless satisfied on reasonable grounds that the exemption—

                2. would not prevent the water organisation or the trustees of the consumer trust (as applicable) from complying with this Act; and
                  1. would not adversely affect—
                    1. the ability of the water organisation to meet its objectives; or
                      1. the financial sustainability of the water organisation.
                      2. If the Minister decides to decline an application for an exemption, the Minister must direct the Secretary to notify the following parties that the exemption has been declined:
