41Transfer of responsibilities to territorial authorities

  1. For the purposes of section 17(8)(b) of the LGA 2002, a regional council may transfer any responsibility for providing water services in its region to a territorial authority in that region.

  2. A territorial authority may not transfer any responsibility for providing water services in its district to the regional council for the region in which that district is located.

  3. In this section, responsibility includes any associated duty or legal obligation.
