When a new water organisation is setting charges for the first time, this section applies to you if you are part of that organisation. You are part of this organisation if you are setting charges and some of your account holders were previously charged for water services based on their property's rateable value.

If this section applies to you, then section 86(6)(b) does not apply to you.

For the first five years, you can set charges based on a property's rateable value, but you must follow some rules. You cannot rely entirely on the property's rateable value to set charges, and you must use other methods as well, such as charging fixed amounts or based on water usage. You must also change your methods every year to rely less on the property's rateable value.

89Charges set by new water organisation

  1. This section applies to a water organisation—

  2. that is setting charges under this subpart for the first time; and
    1. whose account holders, or intended account holders, include persons who, immediately before the organisation’s establishment, were being rated for water services on the basis of a property’s rateable value.
      1. When this section applies, section 86(6)(b) does not apply.

      2. During the 5 years after the organisation’s establishment, the water organisation may set charges under this section based on a property’s rateable value.

      3. However, during that 5-year period, the organisation’s power to set charges based on a property’s rateable value is subject to the following:

      4. it must not rely entirely on a property’s rateable value:
        1. it may use a property’s rateable value and 1 or more other methods (for example, charging fixed amounts or according to water usage) for portions of the charge:
          1. it must annually adjust its methods of setting charges to decrease its reliance on a property’s rateable value:
            1. in the final year, it must use methods other than a property’s rateable value for most of the charge:
              1. by the start of the sixth year, it must use methods other than a property’s rateable value for the whole charge.
