304: Costs of remedial action

If you get a compliance order, you might have to pay for remedial action. A territorial authority or water organisation can ask you to pay back the reasonable costs of this action. This can happen if the action is taken under section 302 or section 303.

You will have to pay the territorial authority or water organisation the costs of remedial action as a debt. This means you will have to pay them back the money they spent on fixing the problem.

This rule is also affected by what is said in section 305.

304Costs of remedial action

  1. A territorial authority or water organisation may recover as a debt due to the territorial authority or water organisation the reasonable costs of any remedial action taken under—

  2. section 302 from the person to whom a compliance order is issued; or
    1. section 303 from any person to whom a compliance order could have been issued in relation to the matter.
      1. This section is subject to section 305.
