The Governor-General can make an order to exempt a water organisation or trustees from a requirement mentioned in section 64. You might get an exemption for some or all of the requirements, and it might come with conditions. The order must say which territorial authority asked for the exemption and why it was granted.

66Exemption order

  1. The Governor-General may, by Order in Council made on the recommendation of the Minister, exempt a water organisation or trustees from a requirement referred to in section 64.

  2. An exemption under this section—

  3. may be granted—
    1. in full or in part; or
      1. with or without conditions; and
      2. must refer to the territorial authority that applied for the exemption; and
        1. must set out the reasons for the exemption.
          1. An order made under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
