When a council is thinking about changing how it manages water services, it must make certain information available to the public. This includes the proposal itself, why the council wants to make the change, and what other options the council considered, as explained in section 30. The council must also explain how the change will affect things like rates, debt, and water service charges.

The council must tell you how the change will impact the community, including any effects on the council's district and surrounding areas. If the change involves transferring ownership of a water services asset, the council must explain how this will affect its debt. For some types of change proposals, the council must also provide information on who will own the water organisation and how it will be structured, as described in section 27(1)(a), (b), or (c).

The council must make all this information publicly available, and it must also tell you how you can give your feedback on the proposal. If the council is considering more than one change proposal, it must make this information available for each proposal.

32Information to be made publicly available

  1. The territorial authority must, when consulting on a change proposal, make the following information publicly available:

  2. the change proposal, an explanation of the change proposal, and the reasons for the change proposal:
    1. the assessment of other options identified under section 30 and the authority’s reasons for not preferring those options:
      1. how proceeding with the change proposal is likely to affect—
        1. the authority’s rates, debt, and levels of service; and
          1. any charges for water services:
            1. arrangements and mechanisms for funding, pricing, invoicing, and collecting charges for water services:
            2. how not proceeding with the change proposal is likely to affect—
              1. the authority’s rates, debt, and levels of service; and
                1. any charges for water services:
                2. the implications of the change proposal for communities throughout—
                  1. the authority’s district; and
                    1. any collective area involved in the change proposal:
                    2. if the change proposal involves transferring ownership or control of a strategic water services asset, a description of how the change proposal is likely to affect the authority’s debt in relation to the asset:
                      1. for a change proposal described in section 27(1)(a), (b), or (c), information on the proposed ownership of, and shareholding arrangements for, the water organisation:
                        1. any other relevant implications of the change proposal that the authority considers will be of interest to the public:
                          1. how persons who will or may be affected by, or who have an interest in, the change proposal may present their views on the proposal to the authority.
                            1. If the territorial authority is considering 2 or more change proposals, it must make the information set out in subsection (1) publicly available in relation to each proposal.
