When you are deciding whether to adopt a change proposal for water services in a collective area, you may also think about how it will affect the communities in that area and the whole district. You can consider the views of people living in the collective area and the district. You can also think about the views of other territorial authorities that are part of the change proposal or are considering adopting it. This rule applies even if it seems to contradict sections 12(4) and 14(1)(g) of the LGA 2002. You should look at these rules when making your decision about the change proposal for water services in the collective area.

33Additional considerations for collective area

  1. When deciding whether to adopt a change proposal that relates to water services in a collective area, a territorial authority may also consider—

  2. the impact of the change proposal on the communities in the collective area (as well as the impact on the authority’s district); and
    1. the views of people in communities in the collective area (as well as the views of people in communities in the authority’s district); and
      1. the views of the other territorial authorities that are—
        1. parties to the change proposal; or
          1. considering whether to adopt the change proposal.
          2. This section applies despite sections 12(4) and 14(1)(g) of the LGA 2002.
