If you are part of a water organisation that wants to get funding for water services infrastructure, you must have a development contributions policy. This policy must include a process for reconsidering a requirement, and this process must follow the rules set out in sections 131 and 132. You will use this process when someone asks you to rethink a decision.

The reconsideration process must explain how someone can ask you to rethink a decision and what steps you will take when you reconsider. You must make it clear how the request is lodged with your organisation and what you will do next.

If you have an agreement with a territorial authority that says they will handle the reconsideration process for you, your development contributions policy must outline what this process will look like, as set out in the agreement under section 127.

125Development contributions policy must contain reconsideration process

  1. If a water organisation has determined to seek funding for water services infrastructure under this subpart, its development contributions policy must set out the process, which must comply with sections 131 and 132, for reconsidering a requirement.

  2. The process for reconsideration must set out—

  3. how the request is lodged with the water organisation; and
    1. the steps that the water organisation will take when reconsidering the requirement.
      1. If a water organisation and a territorial authority have entered, or intend to enter, into an agreement under section 127 that provides for the territorial authority to administer the water organisation’s reconsideration process, the water organisation’s development contributions policy must outline the reconsideration process that is contained in, or is intended to be contained in, that agreement.
