You can object to a development contribution requirement for certain reasons. You may object if you think the water organisation did not consider how your development would reduce the need for water services infrastructure. You may also object if you think the water organisation is asking for a contribution for something not needed for your development.

You can also object if the water organisation did not follow the rules in section 116. You may object if you think the water organisation applied its development contributions policy incorrectly to your development. This means you can dispute the contribution if you think it was not calculated fairly for your specific situation.

134Scope of objections

  1. A person may object to a development contribution requirement only on the ground that the water organisation has—

  2. failed to properly take into account features of the objector’s development that, on their own or cumulatively with those of other developments, would substantially reduce the impact of the development on requirements for water services infrastructure in the water organisation’s service area or parts of that service area; or
    1. required a development contribution for water services infrastructure not required by, or related to, the objector’s development, whether on its own or cumulatively with other developments; or
      1. required a development contribution in breach of section 116; or
        1. incorrectly applied its development contributions policy to the objector’s development.
