25: Third party to give information to water service provider on request

If you are a third party who has an agreement with a water service provider to provide water services, this section applies to you. You have to give the water service provider information about the water services when they ask for it. The information they ask for must be something they need to meet the rules about water services.

The water service provider can ask you for information, and you have to give it to them as soon as you reasonably can. However, you do not have to give them information that is commercially sensitive or could put you at a disadvantage in future negotiations.

You can ask the water service provider to pay you back for the reasonable costs you incur when giving them the information they request.

25Third party to give information to water service provider on request

  1. This section applies if a water service provider has entered into an agreement or arrangement of any kind with a person or body (the third party) for the third party to provide water services on behalf of the water service provider.

  2. The water service provider may ask the third party for information relating to providing water services under the agreement or arrangement.

  3. The information requested must be information that the water service provider needs in order to meet regulatory requirements relating to the water services covered by the agreement or arrangement.

  4. The third party must provide the information requested as soon as is reasonably practicable.

  5. However, the third party is not required to provide information that—

  6. is commercially sensitive; and
    1. could disadvantage the third party in future negotiations for entering into an agreement or arrangement with a water service provider.
      1. The third party may recover from the provider the reasonable costs that the third party incurs in providing information requested under this section.
