138Request to enter development agreement

  1. A water organisation may enter into a development agreement with a developer if either party requests in writing that the parties enter into a development agreement.

  2. The parties to a development agreement—

  3. must include at least 1 water organisation and 1 developer; and
    1. may also include—
      1. 1 or more additional water organisations; or
        1. 1 or more additional developers; or
          1. 1 or more territorial authorities.
          2. A territorial authority may—

          3. enter into a development agreement under this subpart on behalf of a water organisation; and
            1. administer a development agreement under this subpart on behalf of a water organisation.
