281: Purpose of compliance powers

A compliance officer can use their powers under this Act for a few reasons. You might see them checking if people are following the rules, or if they have been, or will be in the future. They can also investigate serious risks to water services, respond to those risks, or look into whether someone has broken the rules or done something against the bylaws.

They can use their powers to take action when someone has done something wrong, like bringing a case to court, and this can be related to a compliance order (see section 297) or another offence under this Act.

281Purpose of compliance powers

  1. A compliance officer may exercise a power under this Act only for 1 or more of the following purposes:

  2. to ensure that compliance requirements under this Act have been, are being, or will be met:
    1. to investigate specified serious risks relating to water services:
      1. to respond to specified serious risks:
        1. to investigate the commission of offences against bylaws and infringement offences under this Act:
          1. to bring proceedings in relation to any compliance order (see section 297) or offence under this Act.
