If you want to renew your licence, the licensing authority can do this if your licence was granted under section 181. You need to apply to the Ministry at least one month before your licence expires, but if your licence includes a special international air service, you need to apply at least three months before it expires. The Ministry will look at your application and decide what to do.

If your licence includes a special international air service, the Secretary will publish a notice about your application and ask people to send in their thoughts about it. The Secretary will give people at least 21 days to send in their thoughts. The licensing authority will then consider your application and make a decision based on the rules in section 180(1)(a) and (b).

When your licence is renewed, it will start from the day your old licence expires. The licensing authority can decide how long your new licence will last, or they can make it last forever if they want to. They will choose a term that they think is right for your situation.

183Renewal of licence

  1. The licensing authority may renew a licence granted under section 181.

  2. An application for the renewal of a licence granted under section 181 must—

  3. be lodged with the Ministry not less than 1 month before the date on which the licence expires; or
    1. be lodged with the Ministry not less than 3 months before the date on which the licence expires, if the licence includes a restricted scheduled international air service for a New Zealand international airline.
      1. If the licence includes a restricted scheduled international air service for a New Zealand international airline, the Secretary must—

      2. publish a notice of the application for renewal of a licence; and
        1. specify in the notice a time, not less than 21 days from the date of the notice, within which the Secretary will receive written representations from any person relating to the application.
          1. The licensing authority must consider and determine an application for renewal of a licence in accordance with the requirements of section 180(1)(a) and (b), which applies with any necessary modifications.

          2. A licence renewed under this section—

          3. takes effect from the date of the expiry of the licence for which the renewal is granted; and
            1. may be granted—
              1. for a term that the licensing authority considers appropriate in the particular case; and
                1. for an indefinite term, if the licensing authority thinks fit.
