If you are in an airside security area, you must be searched before you enter. You will break the law if you do not get searched as required under subpart 2. You also break the law if you are in this area when you are not allowed to be there, according to section 122.

If you are in a landside security area, the same rules apply. You must be searched before you enter if this is required under subpart 2. If you do not get searched, you will break the law.

If you break this law, you might have to pay a fine. You could be given an infringement fee of $1,000. Alternatively, a court could fine you up to $2,500.

167Being present in security area without being searched or when not authorised

  1. A person commits an infringement offence if—

  2. the person—
    1. is present in an airside security area; and
      1. is required under subpart 2 to be searched before entering that area, or that part of the area where the person is present; and
        1. has not been searched as required; or
        2. the person is present in an airside security area or security enhanced area in breach of section 122.
          1. A person commits an infringement offence if the person—

          2. is present in a landside security area; and
            1. is required under subpart 2 to be searched before entering that area, or that part of the area where the person is present; and
              1. has not been searched as required.
                1. A person who commits an infringement offence against this section is liable to—

                2. an infringement fee of $1,000; or
                  1. a fine imposed by a court not exceeding $2,500.
