This part of the law applies to you when you travel by air in New Zealand. It covers trips where you leave from and arrive at a place in New Zealand, and you do not stop anywhere outside New Zealand. You are still covered by this part of the law even if the plane you are on is also carrying people who are travelling internationally.

When you travel by air, it is considered international travel if you leave from one country and arrive in another, or if you stop in another country on your way. This is true even if you are just stopping over and not getting off the plane. If you are travelling within New Zealand, but your plane is also carrying people who are travelling internationally, this part of the law still applies to you.

270Application of this subpart

  1. This subpart applies to any carriage by air (other than international carriage described in subsection (3)) in which, according to the contract between the parties,—

  2. the place of departure and the place of destination are both in New Zealand; and
    1. there is no agreed stopping place outside New Zealand.
      1. Subsection (1) applies even if the aircraft in which the carriage takes place is at the same time engaged in the international carriage described in subsection (3).

      2. The international carriage referred to in subsections (1) and (2) is carriage in which, according to the contract between the parties, the place of departure and the place of destination, whether or not there is a break in the carriage or a transhipment, are—

      3. within the territories of 2 countries; or
        1. within the territory of a single country if there is an agreed stopping place within the territory of another country.
          1. This section applies subject to section 272.
