256Conventions to have force of law
This section relates to the Montreal Convention, the amended Convention, and the Guadalajara Convention (the Conventions).
The Conventions have the force of law in New Zealand in relation to any carriage by air to which any of the Conventions, as the case may require, applies.
However, the Conventions have the force of law in New Zealand only to the extent that they relate to the rights and liabilities of carriers, carriers’ servants and agents, passengers, consignors, consignees, and other persons.
The Conventions apply in New Zealand—
- subject to this subpart; and
- irrespective of the nationality of the aircraft performing the carriage by air.
Each version of Article 22 of the amended Convention set out in Schedule 4 applies in the circumstances outlined in the heading of that version.
