The Director can stop or limit an aviation document if they think it is necessary for safety and security. You might have an aviation document stopped or limited if you have not followed the rules or conditions of the document, or if you have broken certain laws, such as those in section 13, section 107(1), or section 362(1). The Director can also stop or limit an aviation document if they think you are not doing your job properly or if they have concerns about the safety of an aircraft or a service.

The Director can stop an aviation document or add conditions to it if they are not sure an aircraft is safe to fly or if they are not sure a service is being provided safely. You can find more information about what happens next in section 97.

If the Director stops or limits an aviation document, this will stay in place until they decide what to do next. However, the stop or limit will end after 10 working days unless the Director decides to extend it for a longer time.

96Director may suspend, or impose conditions on, aviation document

  1. The Director may suspend, in whole or in part, an aviation document issued under this Act or impose conditions on an aviation document if the Director considers the action is necessary in the interests of safety and security and if the Director—

  2. considers the action is necessary to ensure compliance with civil aviation legislation; or
    1. is satisfied that the holder has failed to comply with any conditions of an aviation document or with the requirements in section 13; or
      1. is satisfied that the holder has contravened section 107(1) or 362(1); or
        1. considers that the privileges conferred on or the duties imposed on the holder by the document have been, or are being, carried out by the holder in a careless or incompetent manner; or
          1. in the case of a holder of a New Zealand AOC with ANZA privileges, has received from the Director of CASA a copy of an Australian temporary stop notice given to the holder.
            1. Without limiting subsection (1),—

            2. the Director may suspend an aviation document relating to the use of any aircraft or aeronautical product, or impose conditions on the aviation document, if the Director considers that there is reasonable doubt about the airworthiness of the aircraft or the quality or safety of the aeronautical product to which the document relates; and
              1. the Director may suspend an aviation document relating to the provision of any aviation-related service, or impose conditions on the aviation document, if the Director considers that there is reasonable doubt about the quality or safety of the service to which the document relates.
                1. The suspension of an aviation document and any conditions imposed remain in force until the Director determines what action, if any, referred to in section 97 is to be taken.

                2. However, any suspension or conditions expire 10 working days after the date on which the suspension or conditions are imposed unless, before the expiry of that 10-working-day period, the Director extends the suspension or conditions for a further specified period.
