13General requirements for aviation participants

  1. An aviation participant must comply with—

  2. civil aviation legislation; and
    1. the conditions attached to any aviation document held by the aviation participant.
      1. An aviation participant who does anything for which an aviation document is required must ensure that they hold—

      2. all the necessary qualifications; and
        1. the appropriate aviation documents; and
          1. other necessary documents.
            1. An aviation participant must ensure that the activities or functions for which an aviation document has been issued are carried out by the aviation participant, and all persons for whom the aviation participant is responsible, safely and in accordance with the relevant prescribed safety and security standards and practices.

            2. An aviation participant who holds an aviation document that authorises the provision of a service within the civil aviation system—

            3. must, if required under the rules, establish and follow a management system that will ensure compliance with the relevant prescribed safety and security standards and the conditions attached to the aviation document; and
              1. must provide training and supervision to all employees of the aviation participant who are doing anything to which the document relates, so as to maintain compliance with the relevant prescribed safety and security standards and the conditions attached to the aviation document and to promote safety and security; and
                1. must provide sufficient resources to ensure compliance with the relevant prescribed safety and security standards and the conditions attached to the aviation document.
