Civil Aviation Act 2023

Aviation security - Aviation security services and aviation security powers - Directions relating to searching and seizing

153: Further provisions in relation to direction by Minister

You could also call this:

"Rules for when the Minister gives directions to the aviation industry"

When the Minister wants to give a direction under section 152, they must talk to the Director and some groups in the aviation industry. The Minister chooses which groups to talk to, based on what they think is appropriate and practical. They do this before giving the direction.

If the Minister gives a direction under section 152, it starts on the date they specify in the notice. This date can be before the notice is officially published, but only if the Minister thinks something urgent needs to happen. They must also talk to the Director and tell all the people who will be affected before that date, except for people who are on an aircraft.

If the direction starts before the notice is published under the Legislation Act 2019, it will stop being in effect 28 days after that date. You can find more information about how notices are published in the Legislation Act 2019.
