If you are applying for an aviation document and you know something that might affect your application, you must tell the Civil Aviation Authority. You must also tell them if you already have an aviation document and you know something that might affect whether you can keep it, especially if it is related to the conditions in section 77. If you do not tell them without a good reason, you can get in trouble.

107Failing to disclose information relevant to granting or holding of aviation document

  1. A person commits an offence if the person—

  2. is an applicant for an aviation document and fails, without reasonable excuse, to provide to the CAA information known to the person that the person knows or should know is relevant to the CAA’s or the Director’s exercise of powers under civil aviation legislation; or
    1. is the holder of an aviation document and fails, without reasonable excuse, to provide to the CAA information known to the person that the person knows or should know is relevant to the condition specified in section 77.
      1. A person who commits an offence against subsection (1) is liable on conviction,—

      2. in the case of an individual, to imprisonment for a term not exceeding 12 months or to a fine not exceeding $30,000, or both:
        1. in the case of any other person, to a fine not exceeding $100,000.
